1) Online Store Terms
You represent that you are at least the age of majority in your state or have parental consent. You may not use the Site for any unlawful purpose. You must not transmit malware, spam, or
harmful code.

2) General Conditions
We may refuse service to anyone for any lawful reason. Content you transmit (excluding payment details) may be transferred unencrypted across networks and adapted for technical requirements. Payment data is encrypted in transit and processed by our payment providers.

3) Accuracy of Information
We try to keep content current but do not guarantee that information on the Site is accurate, complete, or up-to-date. Use of Site content is at your own risk. We may modify or discontinue any part of the Site or offerings at any time.

4) Products & Services (Perishables)
Our products are perishable. Photos are representative; colors and presentation can vary. We may limit quantities or discontinue items. All descriptions and prices may change without notice. See Returns/Refunds below for our perishable-goods policy.

5) Pricing, Billing & Account Info
We may refuse or cancel any order (e.g., suspected fraud). We may limit orders per person/household/account. If we change or cancel an order, we’ll attempt to notify you via the contact info provided. You agree to provide current, complete, and accurate information and
promptly update it.

Accepted payments: credit/debit cards and PayPal (via our processors).

6) Shipping & Delivery (Cold-Pack)

Ship window: Monday–Wednesday to avoid weekend transit.
Speed: 2-Day or Overnight (carrier-dependent).
Packaging: insulated with ice packs or dry ice.
Arrival: designed to arrive frozen—please freeze upon delivery.
Delivery window: carriers typically deliver 8am–8pm local time.
Addresses: we cannot ship to PO Boxes. For hotels/venues/businesses, include the

recipient + organization and ensure someone can receive the parcel.
Weather and carrier delays are outside our control, but you’re protected by our Guarantee (see
Returns/Refunds).

7) Cancellations & Order Changes
You have 12 hours from purchase to request a cancellation or change (items, address,
delivery notes) if the order hasn’t begun processing. After 12 hours—or once a label is
created/packing begins—changes/cancellations are generally not possible due to the
perishable nature of our goods.

8) Returns, Refunds & Guarantee
We do not accept physical returns of food. You’re covered by our 100% Money-Back Guarantee if your order is late, warm on arrival, damaged, or incorrect.

How to request help (within 24 hours of delivery):

Email support@santanasdelray.com with your order # and photos of the shipping label, outer box, inside packaging, and product (overhead + side). We’ll replace or refund promptly.

Exclusions (common): wrong/undeliverable address; package left outside after delivery; recipient unavailable; orders requesting weekend transit; items not handled per directions (e.g.,not frozen on arrival).

Sauces are sold separately and shipped cold; refrigerated on arrival.

9) Optional Tools & Third-Party Links

We may provide access to third-party tools or link to third-party sites. These are provided “as is” without warranties. Use at your own risk and review the third party’s terms and policies.

10) User Content (Reviews, UGC, Feedback)
If you submit reviews, photos, or ideas, you grant Santanas a non-exclusive, royalty-free license to use, reproduce, and display that content for marketing and operations. You’re responsible for ensuring your submissions don’t infringe others’ rights and aren’t unlawful, defamatory, or harmful. We may moderate or remove content at our discretion.

11) Intellectual Property
All Site content (logos, text, graphics, photos) is owned by or licensed to Santanas and protected by law. You may not copy, distribute, or create derivative works without permission.

12) Prohibited Uses
In addition to other prohibitions in these Terms, you must not use the Site to: (a) violate laws; (b) infringe IP rights; (c) harass or discriminate; (d) submit false/misleading info; (e) upload malware; (f) collect or track others’ personal data without consent; (g)
spam/phish/scrape; (h) interfere with security features.

13) Disclaimer of Warranties
Except where prohibited by law, the Site and products are provided “as is” and “as available.” We do not warrant uninterrupted, timely, secure, or error-free service, or that results will be accurate or reliable.

14) Limitation of Liability
To the fullest extent permitted by law, Santanas Delray and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits/revenue/data arising from your use of the Site or products. In jurisdictions that do not
allow certain limitations, our liability will be limited to the maximum extent permitted by law.

15) Indemnification
You agree to indemnify and hold harmless Santanas Delray, its affiliates, and personnel from claims or demands (including reasonable attorneys’ fees) arising from your breach of these
Terms or misuse of the Site.

16) Severability
If any provision is found unenforceable, the rest remains in effect to the fullest extent permitted
by law.

17) Termination
These Terms remain effective unless terminated by you or us. We may suspend or terminate access if we suspect a breach. Obligations accrued prior to termination survive.

18) Governing Law & Disputes
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Venue for any dispute will be in the state or federal courts located in Palm Beach
County, Florida, unless otherwise required by law. You agree to that jurisdiction and venue. (If
you prefer arbitration, tell me and I’ll add an arbitration clause.)

19) Changes to Terms
We may update these Terms at any time by posting a new date/version on this page. Your continued use of the Site after changes are posted constitutes acceptance.
